Lawyers for Andrew Rossig, James Brady, Marko Markovich and the an accused accomplice Kyle Hartwell argued that burglary counts should be tossed against the group because they were not even inside it when they leaped from the 1,776-foot unfinished tower on Sept. 30, 2013.
The decision puts James Brady, Marko Markovich, Andrew Rossig and their alleged lookout, Kyle Hartwell, on track for a January trial over the September 2013 stunt, which raised questions about security at one of the most protected sites in the country.
