Mercedes-Benz USA, Inc., Lemon Law Case No. 2006-0332/MIA A $494,000 Lemon! - Demond v. Workhorse Custom Chassis, Case #01-04-CA-4161 in the Eighth Circuit Court. After a RV Arbitrator erroneously dismissed the Consumer's Lemon Law case, Cousins Law Firm convinced the Circuit Court to grant Summary Judgment in favor of Cousins Law Firm's client, Mr. Demond. - Fischetti v. Isuzu Motors Corp., Case #4D05-2439 in the Florida Fourth District Court of Appeal. Isuzu sued the Consumer of an automobile with defective paint, after the Consumer won his Lemon Law arbitration against them. Cousins Law Firm represented the Consumer's rights and the Court of Appeals ruled that the Consumer does have rights directly against the Manufacturer. The Cousins' client was allowed to sue the Manufacturer for his bad paint job. - Michael Kaufman d/b/a Kaufman Lynn, Inc. v. Automobile Lamborghini, Lemon Law Case no. 2005-0912/WPB. Patrick Cousins defeated the Manufacturer's argument and succeeded in having the vehicle declared a lemon. Lamborghini was ordered to refund the Consumer the lease payments he made to date and to pay off the lease. The Consumer later purchased a different make of automobile. - Eastern Funding, L.L.C. v. Roman, 4003-2795,Cousin's Law Firm's victory reaffirmed that the Federal Arbitration Act is the controlling precedent in interstate commerce arbitration clauses.
